EPA issues notice of violation to Behr Iron and Metal

The U.S. Environmental Protection Agency has issued a notice of violation (NOV) to Behr Iron and Metal, for exceeding air emissions levels at the company’s Rockford, Illinois, scrap metal facility.

In a letter sent to Behr, the EPA points out that violating “Section 113 of the Clean Air Act gives us several enforcement options.” The options outlined in the EPA letter include the following: issuing an administrative compliance order, issuing an administrative penalty order and bringing and judicial civil or criminal action.

According to the EPA, a required installation of an air monitor at the facility in 2015 showed that lead emissions on at least seven days from June through August 2016 exceeded the standard for lead in ambient air.

Behr’s Rockford facility includes the following lead emission sources: two foundry material separators, two thermal processing units, three metal melting pots and one lead recovery rotary furnace.

EPA says that it is taking action now to prevent future violations of the air quality standard.

The company may request a meeting with EPA to discuss the allegations.
